Welcome! We are excited to have you and your child join the Aiino AI community. Our app, provided by Nomisma LLC ("we," "us," "our"), is a play-based learning application designed for children between the ages of 3 and 9.
This document is a legally binding agreement between you, the parent or legal guardian ("you"), and Nomisma LLC. It governs your family's access to and use of the Aiino AI mobile application, our website, and any related services (collectively, the "Service"). By creating an account, accessing, or using our Service, you confirm that you have read, understood, and agree to be bound by these Terms of Use.
1.2 Agreement on Behalf of a Child
You represent and warrant that you are the parent or legal guardian of the child who will be using the Service and that you have the legal authority to enter into this agreement on behalf of your child.
The Service is designed for use by children, but the legal capacity to consent to these Terms and our Privacy Policy resides with the parent or legal guardian. By creating an account, providing consent for your child to use the Service, and/or paying for any subscription, you are creating a binding contract between yourself and Nomisma LLC. You hereby agree to these Terms on your own behalf and on behalf of your child.
You are solely and fully responsible for your child’s use of the Service and for their adherence to these Terms, including our Community Rules. You agree to supervise your child’s use of the Service at all times and to ensure that such use is in accordance with these Terms and all applicable laws. You acknowledge that you are responsible for any and all activity conducted through the account, and you agree to indemnify and hold Nomisma LLC harmless from any claims, damages, or liabilities arising from your child's use of the Service or their breach of these Terms.

Your privacy is critically important to us. Our Privacy Policy, which is a separate document, is an integral part of this agreement. The Privacy Policy describes in detail what personal information we collect from you and your child, how we use and protect that information, and the rights you have concerning your data.
By agreeing to these Terms of Use, you also acknowledge that you have read, understood, and consented to the data practices described in our Privacy Policy. Please review our Privacy Policy for details regarding how we collect, process, retain, and protect your information, including text transcripts created from voice interactions. In the event of any inconsistency between these Terms and the Privacy Policy with respect to data processing, the Privacy Policy will control.

User-Generated Content” includes any content you or your child provides, including text, selections, drawings, and text transcripts generated from your child’s voice interactions with the Service. Aiino does not store audio recordings; only text transcripts form part of User-Generated Content.

2.1 Who Can Use Our Service
The Aiino AI Service is designed and intended for the use of children between the ages of three (3) and Nine (9).
Use of the Service by any child requires the express, verifiable consent of their parent or legal guardian. In compliance with the U.S. Children's Online Privacy Protection Act (COPPA), we require verifiable parental consent for any user under the age of 13 residing in the United States. For users in the European Union, United Kingdom, or other regions, we require parental consent for any child under the locally-defined age of digital consent (typically between 13 and 16 years old).
You are prohibited from creating an account for, or allowing the use of the Service by, any child if you are not their parent or legal guardian or if they do not fall within the intended age band.
2.2 Our Consent Process
Before a child can access the full features of our Service, a parent or legal guardian must successfully complete our parental consent and verification process. This process is designed to ensure that the individual providing consent is an adult and the legal guardian of the child, in compliance with applicable laws like COPPA.

Subject to your and your child's ongoing compliance with these Terms of Use, Nomisma LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use one copy of the Aiino AI application on a compatible device that you own or control.
This license is granted solely for your personal, non-commercial use, for the purpose of enabling your child to access and enjoy the educational features of the Service as intended by us. This license does not grant you any rights to use the Service for any other purpose or to otherwise use our Company Content or intellectual property, except as expressly permitted in these Terms.
3.2 Restrictions on Use
The rights granted to you in these Terms are subject to the following restrictions. You agree that you will not, and will not permit your child or any third party to:
Copy or Distribute: Copy, modify, distribute, sell, or create derivative works of the Service or any part thereof.
Rent or Lease: Rent, lease, loan, resell, sublicense, or otherwise transfer the Service to any third party.
Reverse Engineer: Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Service.
Use for Commercial Purposes: Use the Service for any commercial purpose, for the benefit of any third party, or in any manner not permitted by this license, including using the Service to provide time-sharing or similar services for any third party.
Interfere with the Service: Use any automated system, such as "bots" or "spiders," to access the Service, or take any action that imposes an unreasonable load on our infrastructure or interferes with the proper working of the Service.
Circumvent Security: Attempt to bypass, disable, damage, or otherwise interfere with any security-related features of the Service, including the parental gate or features that prevent or restrict the use or copying of any content.
Violate Laws: Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
Remove Notices: Remove, alter, obscure, or delete any copyright, trademark, or other proprietary rights notices on the Service.
Attempting to extract, reverse engineer, or misuse AI model responses, transcript data, or any system behavior in ways inconsistent with normal child-focused use.
3.3 Updates to the Service
We reserve the right to modify, enhance, or update the Service at any time in our sole discretion. These updates may include bug fixes, new features, or changes that add, modify, or remove existing functionalities. Such updates may be downloaded and installed automatically without providing you with separate notice.
You acknowledge and agree that we have no obligation to provide any specific updates or to continue to provide or enable any particular features or functionality of the Service. Your continued use of the Service following any update will constitute your acceptance of the Service as updated.
3.4 AI and Voice Features
The Service uses artificial intelligence (“AI”) to generate interactive stories, explanations, and conversational responses. AI-generated outputs may occasionally be incomplete, inaccurate, or unsuitable for your child’s needs, and should not be relied upon as professional, educational, medical, or psychological advice.
When your child uses voice features, their speech is captured by the device microphone and converted to text on the device using built-in speech recognition technology. Aiino does not store audio recordings; only text transcripts are processed by our systems and AI partners as detailed in the Privacy Policy.
By enabling voice features, you consent to the creation and processing of such text transcripts. You may disable voice features or request deletion of stored transcripts at any time.
3. License to Use Our Service
3.1 Grant of License
Subject to your and your child's ongoing compliance with these Terms of Use, Nomisma LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use one copy of the Aiino AI application on a compatible device that you own or control.
This license is granted solely for your personal, non-commercial use, for the purpose of enabling your child to access and enjoy the educational features of the Service as intended by us. This license does not grant you any rights to use the Service for any other purpose or to otherwise use our Company Content or intellectual property, except as expressly permitted in these Terms.

4. Community Rules and Prohibited Conduct
4.1 Our Commitment to Safety
Aiino AI is designed to be a safe, positive, and enriching environment for every child. We are committed to upholding the highest standards of safety and well-being, in line with principles such as those found in the UK Children's Code. The well-being of our young users is our highest priority.
We expect all users children and parents alike to contribute to this positive community by interacting respectfully and responsibly within the Service. These community rules are designed to ensure that every user has a safe and enjoyable experience.
4.2 Prohibited Actions
To maintain a safe and positive environment, you agree that you will not allow or encourage your child to engage in any of the following prohibited actions:
Bullying and Harassment: Engaging in any form of bullying, harassment, intimidation, threatening behavior, or personal attacks.
Sharing Personal Information: Attempting to post, share, or solicit personally identifiable information from other users, such as full names, addresses, phone numbers, email addresses, or school names.
Hateful or Inappropriate Conduct: Using hateful, obscene, discriminatory, defamatory, or otherwise inappropriate language, symbols, or content.
Cheating or Exploitation: Attempting to cheat, exploit bugs or glitches in the Service, or otherwise use the app in an unfair or unauthorized manner to gain an advantage.
Uploading Inappropriate Content: Uploading, creating, or sharing any content that is illegal, violent, sexually explicit, promotes self-harm, or is otherwise inappropriate for children.
Impersonation: Impersonating another person, including another user or a member of our staff.
Violation of these rules may result in the immediate suspension or termination of your account, at our sole discretion.
4.3 Reporting Violations
We encourage parents to report any content or behavior they believe violates these community rules or is otherwise inappropriate. If you or your child encounter any violations, please contact us immediately at info@aiino.ai with a description of the issue.
